2023-24 Employee Meal Plan Contract

This contract is between you ("plan participant") and IU Dining on behalf of The Trustees of Indiana University ("University"). Plan participant's acceptance of the terms of this contract is indicated electronically below.

1. Contract Term:
   1. July 1, 2023 – June 30, 2024
2. Date Rates Finalized for Meal Plans: The rates, to which the plan participant is hereby agreeing, will be posted on the IU Dining website in June 2023.

1. "Contract Term" means:
   1. July 1, 2023 – June 30, 2024; IU Dining provides food service during academic sessions with reduced hours and locations during summer sessions and times when in-person classes are not in session.
   2. Dining service, including where and how it will be offered, is subject to the sole discretion of the University.
   3. Due to health and safety guidance adopted by the University and/or Residential Programs and Services (RPS), RPS may limit the occupancy of dining locations, limit the amount of time dining patrons may spend within dining locations, or make other operational adjustments needed related to health and safety concerns (e.g., grab and go meals).
2. "Cancellation Effective Date" means the date plan participant enrollment in the plan ends.
3. "IU Dining website" means https://www.dining.indiana.edu.
4. "AYCTE Dining Halls" means dining locations where an All-You-Care-To-Eat option is available.
5. All dining location(s) are listed on the IU Dining website, which website and available options may be updated or modified at the sole discretion of the University.
6. "Meal Scan" means a component of the employee meal plan. It allows entry into AYCTE Dining Halls. One meal scan is equivalent to one entry.
   1. Meal scans can be used in one of two ways:
      1. for a dine in meal at AYCTE Dining Halls
      2. as a carry out (To-Go) from select AYCTE Dining Halls as defined on the IU Dining website.
   2. Meal scans are for the exclusive use of the plan participant and are not transferable. Meal scans cannot be used for any other individual under any circumstance.
7. "Meal Exchange" means a component of the employee meal plan.
   1. A meal exchange can be used for a guest meal at AYCTE Dining Halls or at select retail dining locations for select menu items as determined by the University
   2. Meal Scan (Block) Plans offer 100% Meal Exchangeability.
   3. Dining locations accepting meal exchanges are listed on the IU Dining website.

In consideration for contracted dining services, plan participant agrees to pay IU Dining the rates specified for the selected meal plan, as announced or as they may be adjusted by Indiana University. The rates, to which the plan participant is hereby agreeing, will be posted on the IU Dining website in the summer of 2023. For purposes of guidance only, specific meal plan rates and fees for the previous year will be available on the IU Dining Website until the 2023–24 rates are posted.

Meal plans can be accessed by the plan participant, and only the plan participant, by presenting the plan participant's CrimsonCard ID card at a dining location. The meal plan available for purchase is outlined below. This plan will be made available only to those employees over the age of 18 years old.

Employee meal plans cannot be used to purchase alcohol or for special events at The Tudor Room such as, but not limited to:

1. Brunch
2. Holiday events

1. Meal Scan 25 - The plan includes two components:
   1. Meal Scan(s) - 25 scans to dine-in at AYCTE Dining Halls during hours of operation. Unused scans are forfeited at the end of the plan participant's Contract Term.
   2. Meal Exchange(s) - 100% of Meal Scans for this plan can be used as Meal Exchanges as defined above.

Requests for a refund can be submitted at one.iu.edu under "Housing Appeals (IUB)". Once purchased, Plan Participant understands and agrees that a refund for a purchased meal plan, or any unused portion/component thereof, is not guaranteed. Full and prorated refunds will be considered on an individual basis in situations such as, but not limited to:

1. The official date of cancellation is prior to the start of the contract term;
2. None of the plan components were ever utilized;
3. The plan participant is called to active military duty;
4. The plan participant is unable to utilize the plan due to a medical condition or ADA requirement;
5. The plan participant is no longer an employee of Indiana University.

Refunds for plan components already utilized by the Plan Participant prior to the date of cancellation will not be provided.

1. Plan participant may purchase a meal plan online with credit card.
2. Failure to pay meal plan charges may result in the suspension of plan participant's dining privileges until the account is paid in full.
3. Plan participant is responsible for reporting a lost or stolen CrimsonCard to the CrimsonCard Office. Plan participant will be responsible for all purchases made with plan participant's CrimsonCard until the time the plan participant's CrimsonCard is reported lost or stolen to the CrimsonCard Office.
4. In the event that the CrimsonCard ID picture does not match the person presenting the CrimsonCard, the card may be confiscated and reported to Office of Human Resources.
5. Plan participant agrees to pay all reasonable costs and expenses, including attorney's fees, court filing fees, collection agency fees, etc., incurred by the University in enforcing this contract.
6. The failure of IU to exercise its options under this contract does not constitute a waiver or relieve plan participant from remaining obligations and duties under this contract.
7. IU reserves the right to make other operational adjustments related to any campus or university closure or suspension of classes on campus. Any such operational adjustment does not constitute a cancellation of this contract.
